Jamendo, the Luxembourg music platform owned by Winamp Group, sued Nvidia in a California federal court in June, claiming the chipmaker trained its Fugatto and Audio Flamingo audio models on the MTG-Jamendo dataset without a commercial licence. It wants at least 17.8 million euros, about $20.3 million.

The 55,600-track dataset was built with the Music Technology Group at Pompeu Fabra University in Barcelona and is offered only for non-commercial research. Jamendo points to Nvidia's own papers, which list it as training data, and says it sought a licence after learning of the use in March 2024, then sent an invoice of 289 euros a track, about 16.1 million in all, which went unpaid.

The complaint adds breach of contract, unjust enrichment and unfair competition to infringement. A parallel case in Ghent is going ahead after a Belgian judge rejected Nvidia's challenge to jurisdiction earlier in June. Nvidia had not commented by publication.
