A German regional court has upheld an injunction stopping the distribution and promotion of a song that reused much of another writer's lyrics. The lyricist wrote them in 2025 and a producer turned them into a song with Suno. A second artist, refused the rights, released her own track built on them anyway.
The defence argued the text was machine-made and therefore unprotected, backed by an expert who pointed to formulaic lines and logical breaks. The court accepted the writer's sworn statement and said stylistic breaks can be artistic choice.
It held that concrete evidence of AI authorship shifts the burden to explain one's process. The ruling can be appealed.
